A Colorado paramedic convicted in the 2019 death of Elijah McClain, a young, unarmed Black man, was sentenced to four years of probation with 14 months of work release on Friday, the final chapter of an explosive case that thrust the Denver suburb of Aurora into the national spotlight and helped usher in sweeping public safety reforms. Jeremy Cooper, 49, a former paramedic with Aurora Fire Rescue, was found guilty in December of criminally negligent homicide. A second paramedic, Peter Cichuniec, 51, a former lieutenant with the department, was sentenced last month to five years in prison. Judge Mark Douglas Warner of the District Court in the 17th Judicial District said neither the jury nor the court saw evidence that Mr. Cooper purposely gave Mr. McClain an overdose though his actions deviated from the standard of care. “It’s almost unthinkable the way things rolled out,” he said, later adding, “It didn’t have to happen.”

A Vermont mother wanted to teach her then-14-year-old son a lesson after he came home with electronic cigarettes he stole from a gas station. The teen eventually was injected with a ketamine, a sedative, then taken to a hospital, according to the lawsuit and video. When the two officers arrived to speak to the teen, Austrian told them her son was acting erratically and had a rough week. The lawsuit says the teen “reflexively rose from the bed and flailed his arms haphazardly at the officers." Officers told him to stop spitting, and paramedics, who police called, placed a spit hood over his head.

A leading doctors group on Thursday formally withdrew its approval of a 2009 paper on “excited delirium,” a document that critics say has been used to justify excessive force by police. The American College of Emergency Physicians in a statement called the paper outdated and said the term excited delirium should not be used by members who testify in civil or criminal cases. Earlier this week, California became the first state to bar the use of excited delirium and related terms as a cause of death in autopsies. Other medical groups, including the American Medical Association, had previously rejected excited delirium as a diagnosis. DENVER — The family of a woman who died four years ago shortly after a paramedic injected her with the powerful sedative ketamine have filed a wrongful death lawsuit against the health care worker and the ambulance company. LaCour's family alleges in the lawsuit that Jason Poulson, a paramedic for American Medical Response Ambulance Service, administered 400 milligrams of ketamine to LaCour despite objections from a firefighter who was also an emergency medical technician. Shortly afterward, LaCour stopped breathing, according to the lawsuit filed on behalf of her and her husband's five preteen children. LaCour died from acute alcohol and ketamine intoxication, the El Paso County Coroner's Office said in its report. The manner of McClain's death is undetermined, according to the amended report. The original autopsy report, signed Nov. 7, 2019, said McClain's cause of death could not be determined, but new information that emerged during a grand jury investigation prompted the state attorney general's office to order a second autopsy. The new autopsy report was released to the public after Colorado Public Radio filed a lawsuit against the Adams County Coroner's Office for denying the news organization's request for a copy of the amended report. Inside an ambulance about seven minutes later, McClain did not have a pulse and went into cardiac arrest, according to a report released later that year by then-District Attorney Dave Young.

REUTERS/Kevin Mohatt//File PhotoDENVER, Sept 23 (Reuters) - Elijah McClain, an unarmed Black man killed in 2019 after an encounter with police in Aurora, Colorado, died of an overdose of the powerful sedative ketamine that was injected by paramedics, a new autopsy report released on Friday concluded. Three police officers and two paramedics were criminally charged in McClain’s death in 2021, following protests. The officers subdued McClain with a carotid neck hold and handcuffed him, according to an indictment. Paramedics then arrived and injected him with a dose of ketamine too high for someone of his weight, according to the autopsy. Following the outcry, Colorado Governor Jared Polis appointed the state’s attorney general to review McClain's death.
